What is the Employee Polygraph Protection Act of 1988?

The Employee Polygraph Protection Act of 1988 (EPPA) prohibits most private employers from using polygraph testing to screen applicants for employment. It does not affect public employers such as police agencies or other governmental institutionsce. Instruments that claim to record voice stress are not polygraphs and have not been shown to have scientific support. www.dol.gov/esa/regs/compliance.

          What is a polygraph instrument?

The polygraphy instrument will collect physiological data from at least 3 systems in the human body. Convoluted rubber tubes that are placed over the examinee's chest and abdominal area will record respiratory activity. Two small metal plates, attached to the fingers, will record sweat gland activity, and a blood pressure cuff, or similar device will record cardiovascular activity.

What if I feel scared about taking a polygraph test and it's outcome?

Many innocent examinee feel guilty about taking their first polygraph exam. The examiner will reassure and relax the subject. Nervousness will not show an innocent person to be guilty.

Will I know what the questions are prior to the test?
Yes. Each question to be asked will be read to you and explained before you take the actual test. There will be no surprise (trick) questions.

Will I know the results of my Polygraph test?
Yes. The American Polygraph Association Standards and Ethics Committee require that the examinee be given the results if requested.

             Who Gets the Test Results?
According to the various state licensing laws and the A.P.A, polygraph results can be released only to authorized persons. Generally those individuals who can receive test results are the examinee, and anyone specifically designated in writing by the examinee, the person, firm, corporation or governmental agency which requested the examination, and others as may be required by due process of law.
